My Calacanis Ethicist Submittal

Ethicist Jason has been doing a series of posts on ethics, based on the NY Times column of the same name by Randy Cohen.

They are pretty good posts and I like the idea of discussing ethics given how much uncertainty there is out there about what is ethical online behavior and what is not.

Here's my submission which I hope Jason will go with at some point.

Is it ethical to use a graphic in your post that is almost identical to the one that Randy Cohen uses in his NY Times column?

Randy Cohen is the very first thing I turn to in the magazine on Sunday. The obvious questions he gets are hilarious (like moving money between bank accounts this weekend), but it's interesting how much people will disagree over some of the more borderline cases. I think Cohen probably has one or two books in him. I'd love to see some of the more borderline cases discussed in longer form.

I think if it is clear you are doing an homage to the author and you are not profiting from it... yeah.

Sort of like doing a cover of a Dylan song at your local bar... yes, you're using Dylan's song, but you're not hurting him and you're showing your love for him.

I love Randy's column and I pay tribute to him by doing my spin on his great work. I'm a big fan of looking at intent and net result.

If you do a cover of Dylan´s song at your local bar, you have to pay royalties to him. You compile a sheet with all the songs you played that night, and then they collect royalties. So you dont have the right to do it for free, even if you are "demonstrating your love" for him.
